Roma Driveways & Landscapes – Terms and Conditions
1. Definitions
“Company” refers to Roma Driveways & Landscapes.
“Client” refers to the person, firm, or company requesting services.
“Works” refers to all landscaping, hard landscaping, driveway installation, and related services provided by the Company.
2. Quotations & Acceptance
All quotations are valid for 30 days from the date issued.
Quotations are based on current material and labour costs and may be subject to change prior to acceptance.
Acceptance of a quotation must be confirmed in writing (including email, text message, or signed document) and constitutes agreement to these Terms & Conditions.
The Company reserves the right to withdraw or amend a quotation prior to written acceptance.
3. Scope of Work
The Works will be carried out as outlined in the agreed quotation.
Any additional work requested by the Client that is not included in the original quotation will be treated as a variation and charged accordingly.
The Company will make reasonable efforts to match materials; however, exact matches (including colour and texture) cannot be guaranteed.
4. Pricing & Payment Terms
Deposit Structure
A total deposit of 30% of the project value is required prior to commencement of any Works to secure the booking and allocated start date.
This deposit is made up of:

A non-refundable 10% booking and mobilisation fee, covering administration, scheduling, and allocation of labour and resources.

A 20% materials deposit, used to purchase materials in advance of the project.
The 10% booking and mobilisation fee is strictly non-refundable.
The 20% materials deposit is refundable only where:

Materials have not yet been purchased, ordered, or allocated; and
-
Cancellation occurs in accordance with Section 14.
Payment Schedule
-
30% deposit payable upfront
-
50% mid-stage payment due at an agreed stage of completion
-
20% final balance due upon completion and issue of invoice
For larger projects (4+ weeks), staged or weekly payments may be agreed in writing prior to commencement.
The Company reserves the right to suspend works if any stage payment is not made when due.
Late payments may be subject to interest in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
5. Site Access & Preparation
The Client must provide access to water and electricity at no cost.
If unavailable, the Company reserves the right to:

Apply additional charges; and/or
-
Delay works until services are available.
The Client is responsible for obtaining all necessary permissions, including planning permission, permits, and party wall agreements.
The Company is not liable for delays caused by restricted access or missing permissions.
Working hours are typically between 8:00am and 4:00pm, Monday to Friday, unless otherwise agreed.
6. Ground Conditions & Underground Services
Quotations assume normal ground conditions. Unforeseen issues may result in additional costs, agreed before proceeding.
The Client must disclose all known underground services (gas, water, electricity, drainage, telecoms).
The Company will take reasonable care; however, it shall not be liable for damage to services that were:

Incorrectly identified
-
Not reasonably visible
7. Materials
All materials remain the property of the Company until paid in full.
Natural materials may vary in appearance and change over time.
Timber may warp, split, shrink, or expand.
Efflorescence may occur and is a natural, temporary process.
Porcelain and manufactured products may have slight tolerances.
All installations are completed in line with industry standards.
These characteristics are inherent and are not considered defects.
Unused materials remain the property of the Company unless agreed otherwise.
8. Timescales & Delays
Start and completion dates are estimates only.
The Company is not liable for delays caused by weather, supply issues, site conditions, or events beyond reasonable control.
Schedules may be adjusted where necessary.
9. Waste Removal
Waste removal is included only if specified in the quotation.
Unless agreed otherwise, waste or surplus materials may remain on-site.
10. Guarantees & Warranty
The Company provides a 5-year workmanship guarantee on works completed by the Company.
This does not extend to:
-
Misuse or damage
-
Natural changes
-
Lack of maintenance
-
Ground movement
-
Third-party work or materials
Soft landscaping is excluded.
Overlay works (including installation over existing surfaces such as driveways, patios, or other structures) and any works carried out on areas prepared by third parties are undertaken entirely at the Client’s risk.
No warranty or guarantee is provided for such works, whether expressed or implied.
The performance, durability, and appearance of the finished surface are wholly dependent on the condition, suitability, and stability of the existing base or previously completed works, which are outside the Company’s control.
The Company accepts no liability for any defects, movement, failure, drainage issues, or deterioration arising from:

Existing surfaces
-
Inadequate or unsuitable sub-bases
-
Work carried out by third parties prior to the Company’s involvement
By proceeding, the Client acknowledges and accepts full responsibility for the condition and suitability of any existing or third-party prepared surfaces.
Material-Specific Limitations
The Company’s workmanship guarantee applies to the quality of installation only and does not extend to the natural characteristics, performance, or ageing of materials used within the Works.
Certain materials are subject to inherent movement, weathering, and change over time. This includes, but is not limited to:

Timber products, which may warp, split, shrink, expand, or rot depending on environmental conditions and maintenance

Decking (including timber and composite), which may experience movement, expansion, contraction, fading, or surface wear over time
-
Composite materials, which may fade, weather, soften, or distort due to temperature changes and UV exposure

These characteristics are natural, expected, and not considered defects under the Company’s workmanship guarantee.
The durability and appearance of such materials are influenced by factors outside the Company’s control, including weather conditions, site exposure, usage, and ongoing maintenance.
Where applicable, manufacturer warranties may apply to specific materials. Such warranties are separate from and do not form part of the Company’s workmanship guarantee.
11. Maintenance Responsibility
The Client is responsible for ongoing maintenance.
Failure to maintain may invalidate guarantees.
12. Liability
The Company holds appropriate public liability insurance.
The Company is not responsible for pre-existing defects, undisclosed services, or minor cosmetic variations.
Liability is limited to the contract value.
Nothing in these Terms limits liability for death or personal injury caused by negligence, or any liability which cannot be excluded by law.
13. Health & Safety
The Company complies with all health and safety regulations.
The Client must keep children and pets away from work areas.
14. Cancellations
Cancellation must be made in writing.
The 10% booking fee is non-refundable.
The 20% materials deposit is refundable only if materials have not been purchased and subject to incurred costs.
Cancellations more than 20 days before start date may receive a partial refund.
Cancellations within 20 days may incur up to 10% additional charge.
All materials and work completed must be paid for.
15. Complaints
Visible issues must be reported within 7 days.
Hidden defects must be reported within a reasonable timeframe.
16. Force Majeure
The Company is not liable for delays due to events beyond its control.
17. Governing Law
These Terms are governed by the laws of England and Wales.
18. Marketing & Promotional Use
The Company may use project images for marketing.
No personal details will be shared without consent.
Clients may opt out in writing before works begin.
19. Resin Bound & Tarmac Surface Finishes
The Client acknowledges that resin bound and tarmac surfaces are hand-installed finishes and may display natural and installation-related variations in appearance.
Resin bound surfaces are installed manually using hand trowelling techniques. Minor variations in texture and finish are normal and within industry standards.
Appearance may vary under different lighting conditions. Variations may be more visible under artificial lighting such as headlights or external lights. These are not defects.
Resin uses natural stone aggregates which may vary in colour and composition. Some may contain iron which can oxidise and cause rust-like markings. This is a natural occurrence and beyond the Company’s control.
The Company will advise where possible on higher iron content blends but accepts no liability for natural changes.
Due to the mixing process, some areas may appear more open or textured due to larger stone concentrations. This does not affect performance and is not a defect.
These characteristics also apply to tarmac surfaces.
All installations are completed to industry standards, and such variations are not grounds for complaint.
20. Agreement
By accepting the quotation in writing, the Client confirms they have read, understood, and agreed to these Terms & Conditions.
